Terms and Conditions

This website and service, shorts.shortfundly.com (the “Shorts Platform”), is owned and operated by SM Smartygen Media Networks Pvt Ltd (“Shortfundly”, “we”, “our”, “us”). By accessing, uploading, viewing, or otherwise using the Shorts Platform, you (“you”, “user”, “creator”, or “viewer”) agree to be bound by these Terms and Conditions (the “Terms” or “Agreement”). If you do not agree, do not access or use the Shorts Platform.

1) Service Description & Scope

The Shorts Platform allows users to upload, publish, discover, and interact with short-form videos and related content (captions, hashtags, thumbnails, sounds, effects, comments, and other materials). Features may include feeds, likes, comments, shares, reporting tools, creator analytics, challenges, and promotional placements. Some features may interoperate with other Shortfundly products or approved third-party services.

2) Eligibility & Accounts

• You must be at least the age of majority in your jurisdiction to create a creator account.
• For viewers under the age of majority, a parent/guardian must consent where required by law.
• You are responsible for safeguarding your credentials and all activity under your account.
• We may require verification (e.g., email, phone, ID checks) to enable certain features.

3) Your Content & License to Shortfundly

You represent and warrant that you own or have all necessary rights to upload and distribute any content you submit (“User Content”), including video, audio, music, images, text, metadata, and branding. You retain ownership of your User Content. You grant Shortfundly a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, transcode, reproduce, adapt, publish, publicly display, publicly perform, distribute, promote, and otherwise use your User Content in connection with operating, improving, and promoting the Shorts Platform (including in feeds, search, recommendations, emails, promotional placements, and on Shortfundly’s official social channels). This license ends when you remove your content from the Shorts Platform, except to the extent your content has been shared, reshared, or incorporated into other works that remain available, or where retention is required by law or for legitimate business purposes (e.g., fraud prevention, legal requests, backups).

4) Community Guidelines & Prohibited Content

You must follow our community standards. Without limitation, the following are prohibited and may result in removal, restriction, or account termination:

• Illegal content, incitement of violence, terrorism, or criminal activity.
• Hate speech, harassment, bullying, or targeted abuse.
• Sexual content involving minors, exploitation, or non-consensual acts.
• Graphic violence or gore without clear educational/newsworthy context.
• Dangerous, self-harm, or highly risky acts encouraging imitation.
• Spam, scams, impersonation, or deceptive/manipulated media.
• Infringing content (copyright, trademark, rights of publicity/privacy).
• Malware, unauthorized scraping, or interference with the service.

We may use automated and human moderation. Enforcement actions are at our sole discretion and may include content removal, feature limits, shadow limits, temporary suspensions, or permanent bans.

5) Music, Sounds & Third-Party Rights

You are responsible for securing all necessary rights (e.g., music synchronization, master use, sound recording, talent/model releases). Upload only content you have the legal right to share. We may provide libraries or tools that include licensed assets—your use of those assets may be subject to additional license terms.

6) Creator Monetization & Promotions (If Available)

Monetization programs (e.g., tips, brand deals, revenue sharing, rewards) may be offered in certain regions and are subject to separate eligibility criteria and policies. Promotional placements (e.g., “featured” slots, challenges) are not guaranteed and may be changed or withdrawn at any time.

7) User Conduct & Platform Safety

• Respect others; do not stalk, harass, or dox individuals.
• Do not attempt to bypass moderation, security, rate limits, or DRM.
• Do not buy/sell accounts, likes, comments, or other manipulative activity.
• Report violations using in-product tools or via support channels.

8) IP Complaints (Copyright/Trademark)

If you believe your rights are infringed, send a notice to [email protected] including: (i) your physical/electronic signature; (ii) identification of the work or mark; (iii) identification of the infringing material and its URL/locator; (iv) your contact details; (v) a good-faith statement that use is unauthorized; and (vi) a statement, under penalty of perjury, that the information is accurate and you are authorized to act for the owner. We may remove or restrict access and may terminate repeat infringers.

9) Privacy

Our Privacy Policy explains how we collect, use, and share data in connection with the Shorts Platform and forms part of these Terms. By using the Shorts Platform, you consent to our data practices. Please review it on our website.

10) Advertising, Sponsorships & Branded Content

The Shorts Platform may display ads and promotions. Creators who post branded content must follow applicable advertising and disclosure laws and any Shortfundly branded-content policies. We may label paid partnerships or promotional materials as required.

11) App Stores & Third-Party Links

If you access the Shorts Platform via a mobile app, additional terms from the app store may apply. Third-party links, embeds, and integrations are provided for convenience; we are not responsible for their content or policies.

12) Service Changes & Availability

We may modify, suspend, or discontinue any feature at any time. We do not guarantee uninterrupted or error-free operation. We may impose limits or restrict access to protect the service or comply with law.

13) Termination

We may suspend or terminate your access, in whole or in part, at any time and for any reason, including suspected policy violations, rights issues, or misuse. Upon termination, your right to use the Shorts Platform ceases immediately; provisions that by their nature should survive will do so (e.g., licenses for already-shared content, disclaimers, limitations, indemnities).

14) Disclaimers

THE SHORTS PLATFORM AND ALL MATERIALS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THAT THE SHORTS PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

15) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHORTFUNDLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SHORTS PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SHORTS PLATFORM SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO SHORTFUNDLY FOR THE SHORTS PLATFORM IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

16) Indemnification

You agree to indemnify, defend, and hold harmless Shortfundly, its officers, directors, employees, agents, and partners from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your User Content; (b) your use of the Shorts Platform; (c) your breach of these Terms; or (d) your violation of any third-party rights or applicable law.

17) Modifications to These Terms

We may update these Terms from time to time. The “Date of Last Update” below reflects the latest revision. Your continued use of the Shorts Platform after an update constitutes acceptance.

18) Governing Law & Jurisdiction

These Terms shall be governed by the laws of the Republic of Singapore, without regard to conflict of laws principles. You submit to the exclusive jurisdiction of the courts of Singapore for any dispute arising from or relating to these Terms or the Shorts Platform.
